Similar to pedestrian accidents, bicycle accidents can occur because the driver of a vehicle was not paying attention to the road. If you’re able to prove the driver was responsible for a collision, you could be eligible to collect damages as a result of the accident.

Driver-caused bicycle accidents are not the only ones subject to Massachusetts law. Other common reasons include violation of bicycle-dedicated space, unsafe road conditions (uneven road, loose gravel, potholes or debris) and road conditions compromised by weather (rain, ice).

In these instances, you may be able to file a claim against Massachusetts state government. Regardless of the type of bicycle accident, if it is determined you have a reason to file a claim, you can collect damages such as medical costs, lost income/wages, emotional distress or pain and suffering.

If you already have vehicle insurance, your insurance provider will cover any damages under PIP, or personal injury protection.

This can only occur if you’ve met the tort threshold, or the minimum severity of injury expressed verbally or through medical expenses (more than $2,000). If you’re able to show you’ve been permanently scarred or disfigured, suffered broken bones or sight/hearing damage, you meet the tort threshold in the state of Massachusetts. This law applies to vehicle-caused accidents only. For non-vehicle-caused accidents, like poor road conditions, you could still be eligible to file a claim against the government or responsible party.
